These Terms of Service (“Terms”) govern your access to and use of the Silver of Truth mobile application, website (when available), and related services, features, or content (collectively, the “Services”) provided by Silver of Truth (“we,” “us,” “our,” or “Silver of Truth”). The Services provide real-time insights, market analysis, educational resources, and other tools related to precious metals such as gold and silver. By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms at any time. Changes will be effective upon posting the revised version in the Services. Your continued use constitutes acceptance of the changes. We will notify you of material changes by posting an updated copy on our Services or through other reasonable means.

Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to form a binding contract.

Account Registration

To access certain features, you must create an account by providing accurate and complete information, such as your email address. You are responsible for maintaining the confidentiality of your account credentials (e.g., using strong, unique passwords) and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach. We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspicious activity, or other reasons, with or without notice.

License and Use Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes only.

You may not:

  • Copy, modify, disassemble, reverse-engineer, decompile, or create derivative works from the Services or any part thereof.
  • Use the Services for any illegal, fraudulent, or unauthorized purpose, including harassment, infringement of intellectual property rights, or transmission of viruses, malware, or harmful code.
  • Scrape, crawl, or extract data from the Services, or overload, flood, or interfere with our servers or networks.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Use the Services in a way that violates any applicable laws, regulations, or third-party rights.

The Services provide informational and educational content only, including AI-generated signals, market data, and analysis. This is not financial, investment, or professional advice. Any decisions you make based on the Services (e.g., related to precious metals investments) are at your own risk. We do not guarantee the accuracy, completeness, or timeliness of any information provided.

Intellectual Property

All content, features, and functionality in the Services (e.g., AI signals, market data, text, graphics, logos, and software) are owned by us or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws. Trademarks such as “Silver of Truth” are our property. No licenses or rights are granted to you by implication or otherwise, except as expressly stated in these Terms.

Subscriptions and Payments

Certain features (e.g., PremiumPlus) require a paid subscription. Payments are processed through third-party providers (e.g., Apple In-App Purchases). We do not store your full payment details. Subscriptions auto-renew at the then-current rate unless canceled through your app store account settings. You may cancel at any time, but no refunds will be provided except as required by applicable law or app store policies.

Disclaimers and Limitations of Liability

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses.

To the fullest extent permitted by law, we disclaim all liability for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claims shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Services; (ii) your violation of these Terms or applicable laws; (iii) your content; or (iv) your infringement of third-party rights.

Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violations of these Terms. Upon termination, all licenses granted to you end, and you must cease using the Services and delete the app from your devices.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any disputes arising from or related to these Terms or the Services shall be resolved through binding arbitration in Tennessee under the rules of the American Arbitration Association (AAA). You waive any right to participate in class actions, class arbitrations, or representative actions.
